Article 1: General provisions
The e-commerce website of Master Distillery, a BV with its registered office at Blekkervijverstraat 17, 9880 Aalter, VAT BE1006.399.744, RPR GENT, (hereinafter referred to as 'Master Distillery'), offers its customers the opportunity to purchase the products from its webshop online.
These General Terms and Conditions ("Terms") apply to every order placed by a visitor to this e-commerce website (“Customer”).
When placing an order through the webshop of Master Distillery, the Customer must expressly accept these Terms, thereby agreeing to the applicability of these Terms, to the exclusion of all other conditions. Additional terms of the Customer are excluded, unless they have been expressly accepted by Master Distillery in advance, in writing, and explicitly.
Article 2: Price
All prices mentioned are in EURO, including VAT and all other taxes or duties to be borne by the Customer. If delivery, reservation, or administrative costs are charged, this will be mentioned separately. The indication of price refers exclusively to the articles as described verbally. The accompanying photos are intended for decoration and may contain elements that are not included in the price.
Article 3: Offer
Despite the fact that the online catalog and the e-commerce website are compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind Master Distillery. With regard to the accuracy and completeness of the information provided, Master Distillery is only bound by a best efforts obligation. Master Distillery is in no case liable for manifest material errors, typographical or printing errors. If the Customer has specific questions about, for example, sizes, color, availability, delivery time, or delivery method, we request the Customer to contact our customer service in advance via the contact options on our website. The offer is always valid while stocks last and can be adjusted or withdrawn by Master Distillery at any time. Master Distillery cannot be held liable for the unavailability of a product.
Article 4: Online purchases
The customer can read the General Terms and Conditions by clicking on the link. Master Distillery is entitled to refuse an order as a result of a serious shortcoming of the Customer regarding orders in which the Customer is involved.
Article 5: Delivery and execution of the agreement
Once the order has been created by the customer, Master Distillery is notified so that the order can be prepared for transport as soon as possible. As soon as we start processing the order, we can notify the customer. The customer will then receive an email stating that we have received the order and that we are preparing the package for shipment. Once the order has been shipped, the customer will receive notification via email that his/her order has been dispatched. The delivery time depends on B-post. We collaborate with Bpost and Bpost aims to deliver domestic parcels within 5 working days. However, this is not guaranteed. For neighboring countries, they have a delivery period of 5 to 10 working days. The delivery rate in Belgium is stated when completing the order. An additional cost is charged to the customer for delivery outside Belgium. The country zone is also requested in the address details. This automatically calculates and adds the additional shipping cost to the order. The customer thus has a clear overview of how the total price was obtained. Deliveries outside the European Union are currently not possible. Any delays caused after delivery by Master Distillery to Bpost are not the responsibility of Master Distillery. Master Distillery makes every effort to deliver the order within the specified period, but cannot guarantee this as it collaborates with external partners. Unless otherwise agreed or expressly stated otherwise, the goods are delivered to the Customer's place of residence within a maximum of 30 days after receipt of the order. However, Bpost aims to deliver domestic parcels the next working day. However, this is not guaranteed. Any visible damage and/or qualitative deficiency of an item or any other deficiency in the delivery must be reported immediately and immediately by the customer to Master Distillery. The risk of loss or damage passes to the Customer from the moment he (or a third party designated by him, who is not the carrier) physically takes possession of the goods. However, the risk passes to the Customer upon delivery to the carrier, if the carrier of the Customer has been instructed by Master Distillery to transport the goods and this choice was not offered by Master Distillery.
Article 6: Retention of title
The purchased items remain the exclusive property of Master Distillery until full payment by the Customer. The Customer undertakes, if necessary, to inform third parties of the retention of title of Master Distillery, for example to anyone who would seize the not yet fully paid items.
Article 7: Right of withdrawal
The provisions of this article apply only to Customers who, as consumers, purchase items online from Master Distillery. The Customer has the right to withdraw from the contract within a period of 14 calendar days without giving any reason. The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, physically takes possession of the last good.
To exercise the right of withdrawal, the Customer must inform Master Distillery, Blekkervijverstraat 17, 9880 Aalter, hello@masterdistillery.be, of his decision to withdraw from the contract by means of an unequivocal statement (e.g. by post or email). To comply with the withdrawal period, the Customer must send his communication regarding his exercise of the right of withdrawal before the withdrawal period has expired.
The Customer must return or hand over the goods to Master Distillery, Blekkervijverstraat 17, 9880 Aalter, without delay and in any event no later than 14 calendar days after the day on which he informs Master Distillery of his decision to withdraw from the contract. The Customer is on time if he returns the goods before the period of 14 calendar days has expired. The direct costs of returning the goods are borne by the Customer. The costs are estimated at a maximum of approximately 10EUR for shipments from Belgium. If the returned product has diminished in value in any way, Master Distillery reserves the right to hold the Customer liable and demand compensation for any decrease in value of the goods resulting from the use of the goods by the Customer beyond what is necessary to establish the nature, characteristics, and functioning of the goods. Only items that are in the original packaging, together with all accessories, instructions for use, and invoice or proof of purchase, can be returned. If the Customer withdraws from the contract, Master Distillery will refund all payments received from the Customer up to that point, excluding standard delivery costs, to the Customer within a maximum of 14 calendar days after Master Distillery has been informed of the Customer's decision to withdraw from the contract. In sales contracts, Master Distillery may wait to refund until he has received all goods back, or until the Customer has demonstrated that he has returned the goods, whichever occurs first. If goods have been removed from their packaging and, for example, have been used, returning them is no longer possible.
Article 8: Warranty
Under applicable legislation concerning the protection of consumers in the sale of consumer goods, the consumer has statutory rights. This statutory warranty applies from the date of delivery to the first owner. Any commercial warranty does not affect these rights. To claim the warranty, the Customer must be able to present a proof of purchase. Customers are advised to keep the original packaging of the goods. For items purchased online and delivered to the Customer's home, the Customer must contact Master Distillery and return the item to Master Distillery at his own expense. Upon detection of a defect, the Customer must inform Master Distillery as soon as possible. In any case, any defect must be reported by the Customer within a period of 2 months after discovery. After this period, any right to repair or replacement lapses. The (commercial and/or legal) warranty never applies to defects resulting from accidents, neglect, falls, use of the item contrary to the purpose for which it was designed, failure to comply with the instructions for use or manual, modifications or alterations to the item, rough handling, poor maintenance, or any other abnormal or incorrect use. Defects that manifest themselves after a period of 6 months following the date of purchase, delivery if applicable, are deemed not to be hidden defects, unless proven otherwise by the Customer.
Article 9: Penalties for non-payment
Without prejudice to the exercise of other rights available to Master Distillery, in the event of non-payment or late payment from the date of default, the Customer shall owe interest of 12% per year on the unpaid amount by operation of law and without notice. In addition, the Customer shall owe Master Distillery, by operation of law and without notice, a fixed compensation of 10% on the amount concerned, with a minimum of 100 euros per invoice. Notwithstanding the foregoing, Master Distillery reserves the right to take back the items that are not (fully) paid.
Article 10: Privacy
Master Distillery respects your personal data and processes it in accordance with applicable Belgian and European legislation. The personal data provided by you (in particular your name, address, email address, etc.) will only be used for the following purposes: the execution of the concluded agreement, processing the order. You have a legal right to access and, if necessary, correct your personal data. Upon proof of identity (copy of identity card), you can obtain, free of charge, a written statement of your personal data via a written, dated, and signed request to Master Distillery, Blekkervijverstraat 17, 9880 Aalter, hello@masterdistillery.be. If necessary, you can also request to correct the data that would be incorrect, incomplete, or not pertinent. If you have given permission for the use of your personal data for direct marketing purposes, you can always oppose this free of charge. To do so, you can always contact Master Distillery. We treat your data as confidential information and will not pass it on, rent it out, or sell it to third parties. Master Distillery keeps online (anonymous) visitor statistics to see which pages of the website are visited to what extent. Article 11: Validity impairment - non-waiver
If any provision of these Terms is declared invalid, unlawful, or void, this shall in no way affect the validity, legality, and enforceability of the other provisions. The failure by Master Distillery to enforce any of the rights listed in these Terms at any time, or to exercise any such right, shall never be deemed a waiver of such provision and shall never affect the validity of these Terms.
Article 12: Evidence
The Customer accepts that electronic communications and backups may serve as evidence.
Article 13: Applicable law - Competent court
Belgian law applies. Unless the Customer is a consumer, only the courts of the Ghent district shall have jurisdiction in the event of any disputes.
